Zantac Maker Accused of Destroying Emails Tied to Recall

According to documents in the Zantac lawsuit, French drugmaker Sanofi destroyed internal emails related to the 2019 recall of its popular heartburn medication. 

A court filing from May 7 noted that the deleted emails will make it more difficult for more than 70,000 former patients to show the drugmaker acted without regard to its dangerous drug. The documents go on to allege that the deletion of the emails “resulted in the delay and/or postponement of key Sanofi deposition.” 

The Zantac lawsuit stems from the drug exceeding allowable limits of the carcinogenic NDMA. The U.S. Food and Drug Administration set an allowable daily limit of 96 nanograms of NDMA. However, researchers found more than 3 million nanograms in a single dose of the heartburn medication. 

How has Sanofi responded to allegations of email destruction?

Officials in the company began an internal probe about the destruction of the emails. They expect to deliver a report to the judge overseeing Zantac cases in August. 

“Although Sanofi has already provided hundreds of thousands of pages of relevant discovery to the plaintiffs, Sanofi has voluntarily disclosed that certain emails requested by plaintiffs were not preserved as intended,” Ashleigh Koss, a U.S.-based Sanofi spokeswoman said in an emailed statement. “There was no intentional destruction of data. Sanofi is working to obtain as much of the data as possible from alternative sources. This issue has no impact on the strong defenses Sanofi has in this litigation, and the company remains fully confident in the safety of Zantac.”

Is Sanofi the only company named in Zantac Lawsuits?

No. In addition to Sanofi, GlaxoSmithKline Plc, Boehringer Ingelheim GmbH, plus another 33 generic drug makers, 25 retailers and four distributors are accused in lawsuits of failing to properly warn users about Zantac’s health risks. 

While several companies are named in lawsuits, only Sanofi has been accused of destroying Zantac emails in relation to the 2019 recall.
